Article 1 : Purpose

The current conditions govern sales by the firm “Laines de mon jardin”, located at 5, Les Thibaudières 85150, Martinet, in France, of hand-made wool and woollen creations, through the internet site www.lainesdemonjardin.com

 

Article 2 : Prices

The prices are published in euros, inclusive of all taxes but exclusive of shipping charges. The firm is not VAT registered.

Sales to countries outside the European Community, might incur customs duties. These duties and amounts are not the responsibility of the firm Laines de mon jardin.

All orders are to be paid in euros.

The firm reserves the right to alter its prices at any moment, but the products will be invoiced according to the price list in force at the moment of ordering and subject to availability.

Orders remain the property of the firm “Laines de mon jardin” until full payment has been received.

 

Article 3 : Orders

Laines de mon jardin reserves the right not to register a payment, and not to confirm an order for any reason which it sees fit, and in particular in the case of an absence of stock, or in case of some difficulty concerning the order received.

 

Article 4 : Validation of your order

All orders which appear on the internet site assume the acceptance of the current general conditions of sale. Each confirmation of an order implies your full and inclusive agreement with the current general conditions of sale, without exception or hesitation.

The sum of the documents supplied and the registration of confirmation serve as validation for the transaction.

You declare that you are fully aware of this. Confirmation of the order is in lieu of a signature and the acceptance of the completed order.

A summary of the information regarding your order and of the current general conditions, will be sent to you in PDF format via the email address confirming your order.

 

Article 5 : Payment

The fact of validating your order implies the obligation on you to pay the indicated price.

Payment of your purchases is achieved with a bankers’ card, thanks to the PayPal secure system. You will be redirected to the secure PayPal site in order to record with maximum security the references of your PayPal or Personal Banker’s Card. If payment is accepted, the order is registered and the contract becomes definitive.

 

Article 6 : Withdrawal of an order

In accordance with the provisions of article L121-21 of the retail code, you are allowed a delay of withdrawal from the purchase of 15 days from the day on which you received your goods in order to exercise your right to withdraw from the sale without having to either supply a reason nor incur a penalty.

Returns must be made in the original packaging accompanied by the complete documentation. You are responsible for completing this satisfactorily. Any damage suffered by the product in the course of this return may cancel the right to withdraw the order.

You are responsible for payment of return transit fees.

In the event of the withdrawal of an order, Laines de mon jardin will undertake to return all sums paid, within 14 days following the notification of your order and through the same means of payment which were used to make the order.

 

Article 7 : Availability

Our products are available as long as they are visible on the site of www.leslainesdemonjardin.com and so long as stock is available. In the even of a product becoming unavailable following the completion of your order, we will inform you by email. Your order will automatically be cancelled and a corresponding refund will be made.

 

Article 8 : Deliveries

Delivery is made to the address indicated at the time of the order, which can only be within the agreed geographical zone. Orders are fulfilled through the French Post Office using COLISSIMO, a tracking delivery service requiring a signature on reception.

In the case of any delay in delivery, an email will be sent to you to inform you of a possible impact  in the form of a delay to the delivery time of which you had been notified. Delivery dates are given as a guide only; if these are in excess of 30 days from the date of sale, the contract may be cancelled and you will be reimbursed according to the conditions of sale covered by Articles L138-1 and L138-2 of the retail code.

Article 9 : Guarantee

All the products supplied by the firm Laines de mon jardin are covered by the legal guarantee stipulated by articles 1641 and following of the Civil Code. In the event that a product does not correspond to its specification, it can be returned to Laines de mon jardin who will take it back, exchange it or issue a refund. Any complaints, requests for exchange or refunds must be made by post to the following address: Laines de mon jardin, 5, Les Thibaudières, 85150 Martinet FRANCE, within 30 days from the date of delivery.

 

Article 10 : Responsibility

The products for sale are in conformity with existing French legislation.

Laines de mon jardin cannot be held responsible in the case of a lack of respect for the law of the country in which the product is delivered. It is your responsibility to verify with your local authority the regulations governing the importation of the products which you intend to order.

Moreover Laines de mon jardin cannot be held responsible for any damage which results from an inappropriate use of the product purchased. We urge you to read and respect the cleaning instructions supplied with the purchased products.

Laines de mon jardin cannot be held responsible for any inconvenience or damage resulting from the use of the internet, in particular a service interruption, hacking or the appearance of computer viruses.

 

Article 11 : Law applicable in case of dispute

The current general conditions of sale are subject to French law. In the case of litigation, the competent court will be the magistrates court of LES SABLES D’OLONNE.

 

Article 12 : Intellectual property rights

All material on the site remains the intellectual property of Laines de mon jardin. No one is authorised to reproduce, re-distribute, commercialise or otherwise use in any other manner, even in part, any content from the site, be it photography, logo, text or other visual material.

 

Article 13 : Personal information

Laines de mon jardin reserves the right to gather information about your name and personal details relating to you. These are necessary in order to fulfil your order as well as to improve the service and information which we supply to you.

These can also be transmitted to the firms which contribute to these relations, such as those which are responsible for supplying services and orders, for their management, fulfilment, processing and payment.

This information and details are also kept on file for security reasons, in order to respect legal and regulatory obligations.

Article 14 : Archival proof

Laines de mon jardin will archive the order forms and invoices in a reliable and durable medium, which will constitue a copy in conformity with the provisions of article L1348 of the Civil Code.

Computerised records of Laines de mon jardin will be considered as proof of all communication, orders, payments and transactions undertaken between the parties.
